Herzlich willkommen bei mRay Stream! Wir freuen uns, dass Sie unsere Software nutzen, um Endoskopie-Videomaterial hochzuladen und anzuschauen.

Data protection is our highest priority. In the following, we would like to inform you about how and which of your data is used and stored by the software, how we protect it, and what rights you have at any time.

The lawfulness of the processing of your data in the described manner is confirmed by your acceptance of the Terms of Use during your initial login or upon any changes to the Terms of Use.

1. Scope

Diese Datenschutzerklärung gilt für die von der mbits imaging GmbH betriebene Software as a Service (SaaS) Variante von mRay Stream (gemeint sind immer alle Einzelkomponenten der Software), über die Endoskopie-Videomaterial ausschließlich anonymisiert hochgeladen werden darf. Eine später mögliche On-Premises-Nutzung durch Kliniken ist hiervon nicht erfasst und erfordert eine separate Datenschutzerklärung.

2. Kurzüberblick

  • Zweck: Upload, Verwaltung und Bereitstellung anonymisierter Endoskopie-Videos (z. B. Lehre, Qualitätskontrolle).
  • Personenbezogene Daten: fallen für Accounts (z. B. Name, E-Mail) und technische Protokolle an; keine Personenbezüge in Videoinhalten erlaubt.
  • Hosting: Processing is carried out exclusively in data centers within the EU operated by Hetzner Online GmbH (data processor). No transfer to third countries takes place.

3. Ihre Rechte

With respect to all personal data described below that you provide to us – directly or indirectly – you have the following rights:

  • Right to object / right to withdraw consent: You may object to the processing of your data at any time. In such cases, the data will be deleted.
  • Right of access: You may request comprehensive information at any time about the personal data we store about you.
  • Right to erasure or rectification: You may request the deletion or correction of your personal data stored by us.
  • Right to data portability: You may receive the personal data we store about you.
  • Right to lodge a complaint with a supervisory authority.

4. Verarbeitete Datenkategorien

Account/Profile Data: Name, email address, if applicable organization/affiliation, password hash, role identifiers (user/admin), consent and permission flags.
Nutzungs-/Protokolldaten: IP-Adresse, Geräte-/Browser-Informationen, Zeitstempel, Login-Ereignisse, Fehler-/Systemlogs.
Support/Communication Data: content of support requests and associated metadata.
Videodaten: nur anonymisierte Videodateien plus technische Metadaten (Dateigröße, Format, Datei-Name (wird gehasht)). Re-Identifizierungsversuche erfolgen nicht.

5. Zwecke & Rechtsgrundlagen (Art. 6 DSGVO, § 25 TTDSG)

  • Bereitstellung von mRay Stream, Login, Nutzerverwaltung – Art. 6 Abs. 1 lit. b DSGVO (Vertrag) und lit. f (betrieblich notwendige Funktionsfähigkeit).
  • Security, Logging, and Error Diagnostics: Art. 6(1)(f) GDPR (IT security, system stability, and integrity).
  • Communication / Support: Art. 6(1)(b) and (f) GDPR.
  • Cookies:
    – Technisch notwendige Cookies (Authentifizierung, Sitzungsverwaltung, CSRF-Schutz): § 25 Abs. 2 Nr. 2 TTDSG (keine Einwilligung), Art. 6 Abs. 1 lit. f DSGVO.
    – Keine Analytics/Tracking-Cookies; kein Drittanbieter-Tracking. 

Hinweis zu Art. 9 DSGVO: Gesundheitsdaten werden nicht als personenbezogene Daten verarbeitet, da Videoinhalte vor Übertragung anonymisiert werden. Die Verbreitung personenbezogener Daten ist untersagt und verstoßen gegen die Nutzungsbedingungen.

6. Client-seitige Anonymisierung

  • Die Anonymisierung erfolgt lokal im Browser.
  • Es wird ausschließlich die anonymisierte Kopie übertragen und gespeichert.
  • Wir betreiben kein Re-Identifikationsverfahren.

7. Cookies

We exclusively use strictly necessary cookies (e.g. session/authentication cookies, optionally refresh token cookies, and CSRF protection tokens).
Retention period: Session cookies are stored until the end of the session. Any persistent authentication cookies (if used) are stored only for the minimum necessary duration.
Steuerung: Da keine optionalen Cookies eingesetzt werden, ist keine Einwilligung via Banner erforderlich. Browser-seitige Löschung ist jederzeit möglich.

8. Empfänger / Auftragsverarbeitung / Hosting

  • Data Processor: Hetzner Online GmbH (EU data centers). A data processing agreement pursuant to Art. 28 GDPR is in place.
  • Other recipients: none.
  • Third-country transfers: not envisaged.

9. Speicherdauer und Löschung

  • Account/Profile Data: retained for the duration of the usage/contractual relationship; thereafter deleted or anonymized, unless statutory retention obligations apply.
  • Protokolldaten: Standardmäßig 90 Tage (betriebs- und sicherheitsbedingt), danach Löschung oder Aggregation.
  • Anonymisierte Videos:
    – User können eigene Uploads jederzeit löschen.
    – Admin-User können alle Videos löschen.
    Löschvorgänge werden protokolliert.
  • Support / Communication Data: retained until final resolution of the request and in accordance with applicable legal documentation and record-keeping obligations.

10. Rollen & Berechtigungen

User und Admin-User sind grundsätzlich gleichgestellt; einziger Unterschied: Admin-User besitzen zusätzliche Löschrechte für alle Videos. Weitere Privilegien bestehen derzeit nicht.

11. Sicherheit (Art. 32 DSGVO)

Wir setzen angemessene technische und organisatorische Maßnahmen ein: TLS-Transportverschlüsselung, Verschlüsselung ruhender Daten, rollenbasierte Zugriffe, Härtung und Monitoring, Backup-/Restore, Prinzip minimaler Rechte, Protokollierung sicherheitsrelevanter Ereignisse.

12. Pflicht zur Bereitstellung / Keine automatisierten Entscheidungen

The provision of basic account data is required for the use of the service. No automated individual decision-making, including profiling, takes place.

13. Rechte der betroffenen Personen (Art. 15–21, 77 DSGVO)

You have the right to access, rectification, erasure, restriction of processing, data portability, and the right to object to processing based on Art. 6(1)(f) GDPR. Any consent may be withdrawn at any time with effect for the future.
You also have the right to lodge a complaint with a data protection supervisory authority (e.g. at your place of habitual residence or at the location of the controller’s registered office).

The application is intended for professional users only. Use by minors is not intended.
